DMCA – Copyright Policy

Welcome to Otakuhood (the “Site”). We respect the intellectual property rights of others and expect our users, contributors and partners to do the same.

Pursuant to the Digital Millennium Copyright Act (“DMCA”), Title 17 of the United States Code, Section 512(c), a copyright owner or an authorized agent may submit a copyright infringement notice to us.

If you believe that material available on our website infringes your copyright, you may submit a good faith takedown request containing the information described below.

Notice of Infringement – Claim

A valid copyright infringement notice should include:

A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.
Identification of the copyrighted work claimed to have been infringed.
Identification of the material claimed to be infringing and information reasonably sufficient for us to locate the material. Please include the URL of the relevant product or page whenever possible.
Information reasonably sufficient for us to contact you, including your name, mailing address, email address and telephone number.
A statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent or applicable law.
A statement that the information provided in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Please be aware that under 17 U.S.C. §512(f), a person who knowingly and materially misrepresents that material is infringing may be responsible for certain damages, costs and attorneys’ fees.

Please submit copyright takedown notices through our Contact Page. Email or electronic submission is recommended so that our team can review the request promptly.

Where reasonably necessary to investigate or respond to a claim, information contained in a copyright notice may be shared with the person or party responsible for the allegedly infringing material.

By submitting a claim, you acknowledge that information relating to your request may be communicated to the relevant party as part of the review process.

Counter Notification – Restoration of Material

If material you submitted has been removed or disabled following a copyright infringement claim and you believe the removal resulted from a mistake or misidentification, you may submit a counter notification.

A counter notification should include the following information in accordance with 17 U.S.C. §512(g)(3):

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled because of mistake or misidentification.
  4. Your name, address and telephone number, together with the statements required under applicable DMCA procedures concerning jurisdiction and acceptance of service of process.
  5. Any additional information reasonably necessary for us to identify and review the original infringement notice.

Please submit your counter notification through our Contact Page. Electronic submission is recommended for faster review.

Repeat Infringer Policy

We take copyright infringement seriously.

Where appropriate and in accordance with applicable law, we may maintain records of copyright complaints and take action against users, sellers, contributors or accounts that repeatedly infringe the intellectual property rights of others.

Depending on the circumstances, such action may include removal of content, restriction of access or termination of an account.

Modifications

We reserve the right to update or modify this policy and our procedures for handling copyright claims at any time.

Any changes will be posted on this page. We encourage users to review this policy periodically for the most current information.
